Terms of Service

1. The Service

Upcheck checks the websites you add: whether they are up, their TLS/SSL certificates, their DNS records, their domain registration, whether text you choose is present on or absent from a page, and whether pages you choose have changed. It notifies you and your team through the channels you configure when a check fails or something is about to expire. The Service is a monitoring aid; it does not fix, renew, or manage your websites, certificates, or domains on your behalf.

2. Accounts and organizations

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account and within organizations you administer, including the actions of members you invite. You must be at least 16 years old to use the Service.

3. Acceptable use

You agree not to:

• Monitor hostnames you do not own or are not authorized to monitor, or otherwise use the Service to probe systems without permission.
• Interfere with, disrupt, or place undue load on the Service or its infrastructure.
• Attempt to gain unauthorized access to the Service, other accounts, or related systems.
• Use the Service to violate any applicable law or the rights of others.

4. Billing and subscriptions

• Paid plans consist of a monthly base fee plus a per-website fee, as shown on the pricing and billing pages at the time you subscribe.
• Payments are processed by Stripe. By subscribing you authorize us to charge your payment method on a recurring basis, including usage-based charges for the websites you monitor.
• Fees are billed in advance for the base plan and according to usage for websites, and are non-refundable except where required by law.
• You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. We may change pricing with prior notice.

5. No warranty

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, timely, or error-free, or that any alert will be delivered. Monitoring is a best-effort aid and is not a substitute for your own operations and renewal processes. You remain solely responsible for keeping your websites available and your certificates and domains valid.

6. Limitation of liability

To the maximum extent permitted by law, Upcheck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill — including any loss arising from a website going down, a certificate or domain expiring, or an alert not being delivered. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to Upcheck, its users, or third parties. On termination your right to use the Service ends, and we may delete your data as described in the Privacy Policy.

8. Changes to the Service and these Terms

We may modify the Service or these Terms over time. Material changes to these Terms will be reflected by updating the “Last updated” date above, and your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

9. Governing law

These Terms, and any dispute arising from them or from your use of the Service, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you use the Service as a consumer, you keep any protection given to you by the mandatory law of the country where you live.
